
Dumpster Rental Agreement for Dumpster Drop-Off and Hauling in Lake Ariel, PA
By ordering a container (dumpster) with HALO HAULING, INC. (further referred to as HALO HAULING) and entering your information in our contact forms, you, the customer, acknowledge receipt of and agree to the terms and conditions. Please review the container (dumpster) rental terms and conditions below to see the details associated with your specific service.
YOUR ORDER FORM, CONTACT FORM, AND THESE TERMS & CONDITIONS ARE CONSIDERED THE ENTIRE AGREEMENT BETWEEN HALO HAULING AND YOU.
Prices may vary and are subject to change. The prices below do not include fuel surcharges.
If you, the customer, cancel a dumpster rental and hauling service order with less than a 24-hour advance notice before a scheduled placement or pick-up of the container (dumpster), you will be charged a $75.00 cancellation fee for each incident.
If you, the customer, are loading any of the following materials:
There is a 5,000 lb. weight limit. All materials must stay below the top rail of the container (dumpster). The Maximum Fill Line is displayed on a container (dumpster) regardless of size.
YOU, THE CUSTOMER, ARE NEVER PERMITTED TO MOVE HALO HAULING’S CONTAINER (DUMPSTER) WITHOUT HALO HAULING'S PRIOR APPROVAL. If you move HALO HAULING'S container (dumpster) without prior approval, you will be charged a $250.00 moving fee in addition to all costs incurred by HALO HAULING to repair and/or retrieve HALO HAULING'S container (dumpster) for each incident.
If you, the customer, and/or a third party load tangible personal property, materials, items, junk, and/or debris above the top of the sidewalls of HALO HAULING'S container (dumpster), we will not pick-up the container and you, the customer, will be charged a $150.00 missed pick-up fee, a $7.00-per-day (or portion thereof) demurrage fee, plus applicable sales tax.
Also you, the customer, must remove any excess height of tangible personal property, materials, items, junk, and/or debris before HALO HAULING'S rescheduled pick-up may occur.
STICKERS OF ANY KIND NOT PERMITTED ON CONTAINER (DUMPSTER). You, the customer, will be charged for removal of stickers and any damage incurred to the container (dumpster), including necessary paint that may be required to cover a sticker or sticker damage.
All orders placed online are subject to final approval to ensure you, the customer, receive the correct dumpster for your contracted job and the service that you should receive. Any balance and/or differences will be billed directly to the form of payment used at the time of order.
Exceeding Tonnage
HALO HAULING cannot lift a container (dumpster) heavier than four (4) tons. If the container (dumpster) is too heavy for the truck to lift, a $150.00 no-haul fee will be applied to your invoice. You, the customer, will be responsible for removing materials until an appropriate removal weight under four (4) tons is achieved before HALO HAULING can reschedule a pick-up.
Terms and Conditions for Dumpster Rentals
Driveways and Parking Areas: You, the customer, warrant that any access/location for equipment is sufficient to bear the weight of all equipment and vehicles required to perform the service. HALO HAULING shall not be responsible for any damage to pavement or accompanying sub-surface or any route reasonably necessary to perform the services herein contracted. In addition, to perform the services herein, HALO HAULING shall not be responsible for any damage to lawns, fences, or shrubbery. You, the customer, assume all liabilities for damage to pavement, roads, lawns, fences, mailboxes, and shrubbery.
Waste Material: You, the customer, represent and warrant that the materials placed in the equipment shall be “waste material” as defined herein and shall contain no other substances. No hazardous materials & waste are permitted.
Customer Price Includes: Delivery of container (dumpster) Pick up of container (dumpster) Disposal of non-hazardous materials (See below for details on hazardous and restricted materials) in the container (dumpster).
All prices quoted on dumpsters are for 1.5 tons of waste.
Please be advised a 10-yard dumpster can hold 3,500 lbs.; a 15-yard dumpster can hold 4,500 lbs.; and a 20-yard dumpster can hold 6,000 lbs. Weight overages (over the 1.5 tons) will be charged accordingly. Additional charges may also apply for materials above the designated fill line.
Additional Fees May Include:
Other charges may apply for weight overages and for can top-offs.
IMPORTANT: Any governmental fines due to excessive weight of the container will be paid for by you, the customer, who leased the container (dumpster) from HALO HAULING. You are liable for all damages to the container while the container (dumpster) is leased in your care.
By paying for our services and entering your information in our contact forms, you now agree to the terms and conditions of this contract and the terms and conditions of our services.
Permits:
You, the customer, shall be responsible for obtaining all necessary permits and governmental approvals, if any, and paying all fees that may be incurred in conjunction therewith.
Prohibited, Hazardous, and Restricted Materials:
The term “hazardous material” shall include but not be limited to, any amount of waste listed or characterized as hazardous by the United States Environmental Protection Agency or any state agency Pursuant to the Resource Conservation and Recovery Act of 1976, and enabled or applicable state law.
Without limiting the foregoing, prohibited, hazardous, and restricted materials, these conditions include, but are not limited to, the following items:

Additional Fees May Include:
- Minimum $100.00 fee for loads needing manipulation, including loads filled above the marked fill line.
- $75.00 fees are charged for any cancellations of container (dumpster) delivery less than 24 hours before scheduled delivery.
- Change of location after initial drop-off (e.g. moving around a property) warrants a $100.00 fee.
- $150.00 trip charge fee for unserviceable conditions (e.g. the container [dumpster] is not ready for pick-up, no room for container [dumpster] drop-off, container [dumpster] is blocked/inaccessible for pick-up).
- The container (dumpster) rental is for seven (7) days. Extra time is billed at $10.00 per day.
- A BURN FEE OF $3000.00 WILL BE APPLIED IF YOU BURN IN THE CONTAINER (DUMPSTER).
- THERE WILL BE A $75.00 SURCHARGE ON ALL RETURNED CHECKS.
- ALL CREDIT CARDS DECLINED OR CHARGEBACKS INCURRED WILL BE ASSESSED A FEE OF $50.00.
Other charges may apply for weight overages and for can top-offs.
IMPORTANT: Any governmental fines due to excessive weight of the container will be paid for by you, the customer, who leased the container (dumpster) from HALO HAULING. You are liable for all damages to the container while the container (dumpster) is leased in your care.
By paying for our services and entering your information in our contact forms, you now agree to the terms and conditions of this contract and the terms and conditions of our services.
Permits:
You, the customer, shall be responsible for obtaining all necessary permits and governmental approvals, if any, and paying all fees that may be incurred in conjunction therewith.

- Batteries
- Antifreeze
- Paint (Unless Dried Latex Paint)
- Petroleum-Contaminated Soil
- Dirt
- Lead Paint Chips
- Rocks
- Concrete
- Fluorescent Tubes
- Kitchen Waste (Food)
- Medical Waste
- Railroad Ties
- Animal Carcasses
- Oils
- Barrels
- Industrial Waste
- All Liquids
- Chemical Products
- Radioactive Material
- Oil Filters
- Herbicides
- Pesticides
- Recyclable Electronic Devices (TV, Radio, VCR, DVD Player)
- Tires
- Refrigerators
It is unlawful to improperly dispose of any radioactive, volatile, highly flammable, explosive, biomedical, infectious, toxic, or hazardous material. When in doubt, please ask!
Disclaimer of Warranties:
Except as expressly set forth in the agreement, the services and the container (dumpster) to be provided by HALO HAULING hereunder falls to you, the customer, are to be provided as is, where is, with all faults, and without warranties of any kind–expressed or implied–including any warranty or merchantability of fitness for a particular purpose.
Indemnity Provision:
You, the customer, shall defend, indemnify, and hold harmless HALO HAULING, Jennifer Martirano (President and CEO), and their respective employees, agents, directors, and officers against all claims, costs, and expenses, including but not limited to attorneys’ fees, losses, and damages caused by, arising out of, or resulting from the performance of the work, provided that any such claim, cost, loss or damage: Is attributed to bodily injury, sickness, disease or death, or injury to, or loss of use, or destruction of tangible property (other than the work itself) Is caused in whole or in part by any negligent act or omission of you, the customer, any subcontractor, any supplier, any person or organization directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, regardless of whether or not it is caused in part by any negligence or omission of a person or entity indemnified hereunder.
The obligations of indemnification contained herein shall exclude only those matters in which the claim arises out of the sole negligence of you, the customer, or any of their respective agents, employees, or servants.
Governing Law:
This Agreement shall be interpreted, constructed, and enforced in accordance with the laws of the Commonwealth of Pennsylvania. All parties hereby irrevocably consent that in the event litigation is filed to enforce the terms of this Agreement, such litigation shall be instituted only in the Court of Common Pleas of Wayne County, Pennsylvania, or Wayne County District Court 22-03-2, as determined by the amount in dispute. You, the customer, hereby consent to the personal jurisdiction of said Courts. The parties hereto waive their right to a trial by jury.
Entire Agreement:
This Agreement sets forth the entire understanding and Agreement of the parties with respect to the subject matter hereof and supersedes all other agreements, written or oral, between the parties relating to the service.
Severability:
If any part of this Agreement is legally declared invalid or unenforceable, all other parts of this Agreement are still valid and enforceable. Such invalidity or unenforceability will not invalidate or render unenforceable any other portion of this Agreement.
You, the customer, hereto agree that social media platforms or other electronic means shall not be utilized to defame, disparage, or reconcile grievances stemming from the professional relationship of the parties herein.
HALO HAULING, the contractor, shall vigorously pursue litigation and/or other legal means to prosecute any violation of this clause by you, the customer.
Further, you, the customer, agree that if a court or other adjudicatory body find that you violated this clause, you will be responsible for all legal fees and costs of HALO HAULING, the contractor, to pursue redress for violation of same including pecuniary loss, loss profits, liquidated damages, and/or statutory penalties.
Payment and Billing:
You, the customer, hereby agree to pay all costs and expenses to HALO HAULING for the collection of unpaid amounts including–without limitation–attorney fees in an amount equal to fifteen percent (15%) of the balance due, but in no case less than seven hundred fifty dollars ($750.00), court costs and other costs allowed by the law; provided, however, that the amount of attorney’s fees collected shall not exceed the attorney’s fees actually incurred.
Contractors, Subcontractors, Homeowners or Agents thereof: A lien will automatically be placed on the property at which the container (dumpster) was rented for any non-payment or chargebacks. This will include interest of 10% per annum.
